With regard to the new European data protection legislation (GDPR), which becomes effective on May 25th, 2018, we would like to answer the most commonly arising questions.
Is the verification of applicant details (Pre-Employment Screening) by SIGNUM Consulting realizable in consideration of the new GDPR?
Yes, the process of our reference checks already fulfills the requirements of the EU-GDPR. We have more than 20 years of experience in processing personal data within recruitment in accordance with the German Federal Data Protection Act (BDSG). Without a justified interest and the applicant's signed declaration of consent, which allows to pass on his data to us, PES compliant with data protection regulations would not be possible.
What changes with the new GDPR for PES?
Our procedure will not change. Before and after the 25th of May, personal data may only be processed and stored if it is necessary for establishing the employment and the applicant's consent is given voluntarily. The new legal basis in Germany is § 26 BDSG. The GDPR includes the applicants consent (article 7) as well as the balancing of interests (article 6). In the future, the EU GDPR takes precedence over applicable national laws. This means that every company which is active in the European market must abide by the new law – irrespective in which European country the headquarter is based.
How does data protection compliant work of your PES analysts in practice?
The reference requests are processed by sending the respective personal documents to the issuing persons and institutions. However, these are only used for verification purposes and are completely deleted after processing. The verification process is supported by SIGNUM Consulting's own software, which guarantees an encrypted data transfer and a standardized, transparent process flow.
How do you ensure that your company operates in accordance to the GDPR?
Our quality promise includes the processing of applicant data in strict compliance with data protection regulations. In addition to our qualified PES analysts, who are regularly trained in data protection and information security, we are in demand at information events and customer workshops on the new regulations and changes.
